for accommodation agreements (Kreischberg Suites)

1 Scope

These General Terms and Conditions („T&Cs“) apply from the moment of publication on https://kreischbergsuites.nl/ to all offers, reservations, and accommodation agreements relating to all accommodations rented out by Kreischberg Suites.

Special agreements are not excluded by these General Terms and Conditions. These General Terms and Conditions apply subsidiarily to any special agreements.

2 Definitions

Accommodation provider: a natural or legal person who provides accommodation to guests for payment.

Guest: a natural person who makes use of accommodation services.

Contract partner: a natural or legal person who concludes an accommodation agreement as a guest or on behalf of a guest.

Accommodation Agreement: the agreement between the accommodation provider and the contracting party, the content of which is governed by the following provisions.

3 Conclusion of the agreement

The accommodation agreement is concluded by the acceptance by the accommodation provider of the offer made by the contracting party.

Price reductions and/or special offers may only be taken into account if the contracting party has already expressly invoked them when making the offer.

The conclusion of the accommodation agreement is documented by sending a booking confirmation to the contract partner.

4 Prizes

The prices published on the website https://kreischbergsuites.nl/ at the time of the offer apply.

In addition to the overnight rate, the mandatory costs for final cleaning and the linen package (bed linen as well as hand and bath linen) are payable, as well as the statutory tourist tax (Kurtaxe). Furthermore, costs may be charged for optional extra facilities, nursing/care, and special requests.

The resulting total price is stated in the booking confirmation.

All prices include statutory value added tax. If the statutory VAT rate changes between the booking confirmation and the start of the stay, the prices will be adjusted accordingly. This may result in either an increase or a decrease in the total price. The accommodation provider shall inform the contracting party of such a change without delay. If the price increase exceeds 5%, a contracting party who is a consumer within the meaning of Article 1 of the German Commercial Code (KSchG) has the right to terminate the accommodation agreement within 14 days of notification of the changed total price.

5 Payments

Immediately upon receipt of the booking confirmation, a deposit of 30 % of the total price must be paid. The remaining balance must be transferred to the accommodation provider's account specified in the booking confirmation no later than 30 days before the start of the stay.

For bookings made within 30 days prior to the start of the stay, the total price is due immediately upon receipt of the booking confirmation.

The agreed total price, including all additional services and statutory value added tax, must be paid in full no later than the guest's departure.

The accommodation provider is not obliged to accept foreign currency. If foreign currency or bank transfers are accepted, the guest or contracting party shall bear all associated costs.

6 Deposit

To cover outstanding claims and any potential damage, a security deposit of up to € 200 per accommodation unit must be paid at the start of the stay in the form of a credit card authorization. The specific amount of the security deposit is published on the website https://kreischbergsuites.nl/ and is stated in the booking confirmation. If a credit card authorization is not possible, the guest may be refused access to the accommodation; in that case, the accommodation provider is entitled to terminate the agreement with immediate effect.

The settlement of the security deposit takes place within 14 days after departure. The accommodation provider is entitled to collect amounts up to the authorized sum; any excess will be released. This release does not constitute a waiver of rights by the accommodation provider. Furthermore, the accommodation provider is entitled to assert further claims separately within the statutory limitation periods.

7 Beginning and end of the stay

The guest has the right to occupy the rented rooms from 16:00 on the agreed arrival day, unless an earlier time is stated in the booking confirmation.

If an accommodation is occupied for the first time before 6:00 a.m. pursuant to an agreement to that effect, the preceding night counts as the first overnight stay.

On the day of departure, the rented rooms must be vacated no later than 10:00 AM. In the event of late vacating, the accommodation provider is entitled to charge for an extra night.

8 Revocation/dissolution of the stay agreement

Termination by the accommodation provider:

If the contracting party fails to meet its payment obligations under the accommodation agreement in a timely manner, particularly with regard to the down payment, the remaining payment, or the security deposit, the accommodation provider is entitled to terminate the accommodation agreement without setting a further deadline.

If the guest does not arrive before 21:00 on the agreed arrival day, there is no obligation to provide accommodation, unless a later arrival time has been agreed. If payments have already been made (deposit, final payment), the accommodation remains reserved for the duration of the payments made, but no later than 18:00 on the fourth day (with the agreed arrival day counting as the first day), unless a later arrival day has been communicated.

No later than 90 days before the agreed arrival date, the accommodation agreement may be terminated by a unilateral declaration of the accommodation provider for commercially justified reasons.

Termination by the contractual partner:

Up to 60 days prior to the agreed arrival date, the accommodation agreement may be terminated by a unilateral declaration of the guest or contracting party without payment of cancellation fees. After that, termination is only possible upon payment of the agreed cancellation fees.

Obstacles upon arrival:

If, as a result of unforeseeable, exceptional circumstances beyond the guest's control (e.g. extreme snowfall, high water), the guest is unable to arrive at the accommodation on the day of arrival, and all options for travel are impossible, there is no obligation to pay the agreed amount for the duration of the impediment.

If arrival becomes possible again within three days, the payment obligation revives from that moment.

9 Provision of alternative accommodation

The accommodation provider is entitled to make adequate alternative accommodation of equivalent quality available to the guest, insofar as this can reasonably be expected of the guest, particularly in the event of minor and commercially justified deviations.

A business justification exists, for example, when the rented premises have become unusable, guests already accommodated extend their stay, there is overbooking, or important business measures make this necessary.

Any additional costs for the replacement accommodation shall be borne by the accommodation provider.

10 Pets

Bringing pets is not allowed in designated accommodations.

11 Obligations of the contract partner

The guest is obliged to handle the rented spaces and their furnishings with care, and to report any damage or defects to the accommodation provider without delay.

The contracting party is jointly and severally liable, together with the guest, for all damage culpably caused by the guest, persons attributable to him, or pets brought along by him.

12 Rights of the contracting party

By entering into the accommodation agreement, the contracting party acquires the right to the customary use of the rented premises and of the generally accessible facilities of the accommodation, as well as to the customary service.

The exercise of these rights must be in accordance with any hotel and guest guidelines (house rules), which can be consulted in the apartment.

13 Obligations of the accommodation provider

The accommodation provider is obliged to provide the agreed services to an extent corresponding to the standard of the accommodation.

Not included in the accommodation price, chargeable extra services are – depending on the resort and the type of accommodation – specifically the provision of bed linen, towels, bath towels, and cots, and final cleaning.

14 Rights of the accommodation provider

The accommodation provider is entitled to draw up a final statement or interim statement at any time.

If the contracting party refuses payment of the agreed amount or is in default thereof, the accommodation provider shall be entitled to the statutory right of retention pursuant to Article 970c of the General Terms and Conditions and the statutory right of pledge pursuant to Article 1101 of the General Terms and Conditions on the items brought in by the guest.

These rights serve as security for all claims arising from the accommodation agreement, in particular for the accommodation price, additional services, and any claims for damages.

15 Limitations of Liability

If the contracting party is a consumer within the meaning of Section 1 of the German Commercial Code (KSchG), the accommodation provider's liability for slight negligence is excluded, with the exception of personal injury.

If the contracting party is an entrepreneur, the accommodation provider's liability for both slight and gross negligence is excluded. In that case, the contracting party bears the burden of proof regarding the fault.

The claim for compensation is in any event limited to the amount of the negative contractual interest (interest in reliance). Consequential damage, non-material or indirect damage, and lost profits are not compensated.

The liability of the accommodation provider under §970 et seq. of the General Terms and Conditions remains unaffected by this.

16 Liability for items brought in

The accommodation provider is liable pursuant to §970 et seq. of the General Terms and Conditions for Civil and Customs Administration (ABGB) for items brought in by the guest. The amount of liability is limited to the statutory liability limits.

The liability of the accommodation provider lapses if the damage caused is not reported without delay. This does not apply if the items have been taken into custody by the accommodation provider.

The limitations of liability of 15 apply.

17 Extension of the stay

There is no right to extend the stay. Extension is only possible with the permission of the accommodation provider.

If the guest is unable to depart due to unforeseeable, exceptional circumstances beyond their control (e.g. extreme snowfall, high water), the accommodation agreement will be automatically extended for the duration of the impossibility. The accommodation provider is entitled to charge the customary fee.

18 Termination of the residence agreement

If the accommodation agreement is concluded for a fixed term, it terminates upon the expiration of the term. In the event of early departure, the accommodation provider is entitled to claim the full agreed fee, less saved costs or rental income earned elsewhere.

The accommodation provider may terminate the agreement with immediate effect if there is a compelling reason for doing so. Compelling reasons include, in particular, the following cases, in which:

a) the guest (including persons attributable to him) makes significantly detrimental use of the rented spaces or the common areas of the accommodation, or otherwise behaves in a grossly improper manner towards the accommodation provider, its staff or other guests;

b) the guest suffers from a contagious disease or otherwise becomes in need of care;

c) due claims of the accommodation provider are not paid, despite the setting of a reasonable period;

d) performance of the agreement by the accommodation provider becomes impossible due to force majeure. Force majeure exists when performance of the agreement is wholly or partially prevented by circumstances beyond the accommodation provider's control (e.g. war, natural disasters, strikes, government measures).

The accommodation agreement terminates with immediate effect due to the death of the guest.

19 Illness of the guest

If a guest falls ill during the stay, the accommodation provider will arrange for medical care at the guest's expense upon request, or in the event of a risk of delay.

The accommodation provider is entitled to reimbursement of all costs incurred as a result of the guest's illness, as well as other disadvantages (e.g. cleaning and disinfection costs, lost rental income).

20 Other provisions

Set-off by the contractual partner is only permitted in the event of the accommodation provider's inability to pay, or in the case of claims that have been irrevocably established or acknowledged by the accommodation provider.

Obvious printing errors do not bind Kreischberg Suites.

21 Complaints

Despite all efforts by the accommodation provider, guest complaints cannot be ruled out. Any complaints must be reported immediately to the accommodation provider's staff or the administration office, so that they have the opportunity to rectify the situation.

22 Data protection

Kreischberg Suites processes the guest's personal data in accordance with the provisions of the General Data Protection Regulation (GDPR) and the Austrian Data Protection Act (DSG).

Guest data is retained only for as long as necessary for the stated purposes or as required by statutory retention periods.

Provision to third parties takes place only to the extent necessary for the performance of the agreement or pursuant to legal obligations (e.g. administration office, tax advisor, tourism association).

In accordance with the GDPR, the guest has the right to access, rectification, erasure, restriction of processing, and data portability.

23 Place of performance, applicable law and competent court

The place of performance is the location of the accommodation for which the booking has been made.

The agreement is governed by Austrian law, to the exclusion of private international law and the Vienna Sales Convention (CISG).

If the contractual party is an entrepreneur within the meaning of 1 KSchG, then only the court with material jurisdiction over the place of establishment of Kreischberg Suites shall have jurisdiction.
